Course Booking Terms and Conditions
1. Fees
1.1 Course fees are inclusive of all costs except otherwise stated.
1.2 Places can only be reserved by submitting the completed booking form & full payment.
1.3 Course places cannot be provisionally booked or reserved by telephone/email/letter.
1.4 If a booking is made prior to commencement of the course the whole fee must be submitted upon booking.
1.5 Course fees are reviewed on a regular basis and costs are subject to change, as such our service fees can increase each year in line with inflation and in line with what our competitors are charging for similar services, likewise fees can increase to improve the quality and content of our courses to provide a better experience for our customers. We pride ourselves in offering highly qualified instruction and coaching and our service fees reflect our quality of services.
2. Amendments by the Customer
2.1 Substitution of the original customer for another can be made provided at least 2 weeks’ notice is given by the substituted customer to Jamie M. Langler t/a Climb Devon and the substituting customer satisfies the requirement of the course. All substitutions must be made with the consent of Jamie M. Langler t/a Climb Devon.
2.2 A customer may apply, in writing, to change course or course dates as long as the original booking is more than 2 weeks from the date of the request.
2.3 Any requests to change course or course dates within the 2 week period will be dealt with under the terms and conditions relating to cancellation by the customer.
3. Cancellation by the Customer
3.1 All cancellations must be in writing and acknowledged by Jamie M. Langler t/a Climb Devon. The financial cost of cancellation is as follows:
3.2 25% of the total course fee is due where cancellation takes place more than 4 weeks before the commencement of the course; or
3.3 75% of the total course fee is due where cancellation takes place less than 4 weeks but more than 2 weeks before the commencement of the course; or
3.4 100% of the total course fee is due where cancellation takes place within the period of 1 – 14 days before the commencement date of the course; or
3.5 100% of the total course fee is due where cancellation takes place on or after the commencement date of the course.
4. Cancellation by Jamie M. Langler t/a Climb Devon
4.1 Whilst every attempt is made to ensure that courses/activities actually run, Jamie M. Langler t/a Climb Devon will notify the customer of cancellation as soon as practicable where it believes on reasonable grounds that cancellation is necessary due to dangerous and/or unsuitable conditions for the course/activity.
4.2 Jamie M. Langler t/a Climb Devon shall notify the customer of cancellation not less than five days prior to the commencement of the course where numbers as a result of either customer(s) cancellation or booked numbers have failed to reach a workable minimum.
4.3 Cancellation by Jamie M. Langler t/a Climb Devon does not affect a customer’s right to a refund of travel costs that he/she may have incurred prior to the cancellation and since lost except in the circumstances set in the clauses 4.1 and 4.2.
4.4 In the event of cancellation customers will be offered the choice of the following options:
4.4.1 Full refund of the fee paid; or
4.4.2 Another booking on a different date
Most courses will be delivered by Jamie M. Langler t/a Climb Devon, however some courses may be outsourced. Appropriate efforts will be made to ensure the delivery team hold relevant qualifications and insurance to cover the activity assigned - The instructors used by Jamie M. Langler t/a Climb Devon can be found in the team section of the website. Any case brought against Jamie M. Langler t/a Climb Devon or associates must be conducted in the United Kingdom.
Jamie M. Langler t/a Climb Devon is fully insured with the world’s largest insurance broker, Lockton UK under the Ascend Insurance, for public liability, professional liability, products liability and employers liability. This insurance applies for all activities within the remit of the Mountain Training qualifications currently held, including low level team building activities, bush-craft, route setting, film and media work. Currently activities insured for fall underneath the scope and remit of the following Mountain Training qualifications; Mountain Leader, Rock Climbing Development Instructor, Development Coach Award.
Participants may wish to consider taking out their own insurance against personal accident and personal injury as well as cancellation of courses. This needs to cover the activities that participants will be undertaking in their course. Such insurance may be obtained from: British Mountaineering Council from www.thebmc.co.uk.
5. Negotiation of our Fees and Discounts
5.1 Jamie M. Langler t/a Climb Devon does not currently offer discounts or negotiation of fees except in the circumstances of long term clients booking and paying for multiple services at checkout or for subscribers to our mailing list.
5.2 when paying for multiple services, Climb Devon can offer a discretionary discount on an individual basis.
5.3 Subscribers to our mailing lists regularly receive exclusive offers and discounts on our services.
5.4 Climb Devon reserves the right to not offer discounts on our services, particularly where this will impact the quality and provision of our services.
Gift Cards
Purchasing a digital gift card creates a unique code. The gift card recipient can enter this code at checkout to subtract the gift card value from their order total.
The gift cards never expires.
GIFT CARD LIMITATIONS
Gift cards are sold as unique digital codes. Climb Devon doesn’t create or ship physical gift cards.
At checkout, a gift card’s value will be subtracted from the order total. This includes tax and shipping.
Gift cards never expire.
When purchasing a gift card, customers will go directly to checkout after clicking Purchase. Gift card checkout doesn’t include custom forms or fields.
Gift cards are only available on the Climb Devon website.
CAN I PURCHASE PHYSICAL/PLASTIC GIFT CARDS?
Gift cards are only available through our store as an email or printable .pdf.
HOW DO CUSTOMERS REDEEM THEIR GIFT CARD?
After the recipient receives their gift card, they can redeem it by purchasing products and entering the gift card code at checkout. They can apply the gift card to any physical, digital, or service product. Customers can't use gift cards to buy subscription products.
Gift cards apply to the order total, including tax, shipping, and any transaction fees. If the order total exceeds the gift card value, they'll pay the remaining amount using our store's supported payment methods or another gift card.
If their order total is less than the gift card value, they can complete checkout without another payment method. The amount applied and remaining value displays in the gray box and in the order receipt at checkout.
DO GIFT CARDS COVER TAX AND SHIPPING?
Yes.
CAN CUSTOMERS SPLIT AN ORDER BETWEEN A GIFT CARD AND A CREDIT CARD?
Yes. If their order total exceeds the value remaining on their gift card, they can pay the balance using standard payment methods.
CAN CUSTOMERS USE MORE THAN ONE GIFT CARD ON AN ORDER?
Yes. Customers can apply multiple gift cards to an order.
CAN I USE LESS THAN THE FULL VALUE OF MY GIFT CARD?
When using a gift card, the full value of the gift card is always applied. It isn’t possible to partially redeem a gift card unless the order total is less than the gift card balance.
DO SALE PRICING AND DISCOUNTS APPLY TO PURCHASING GIFT CARDS?
No. Sales pricing and discount codes can’t be applied to purchasing a gift card. However, these discounts will apply to orders made using a gift card.
CAN I GET A REFUND FOR A GIFT CARD?
Yes. You can request cancel and refund unused gifts cards. Partially used gift cards can't be refunded.
CAN CUSTOMERS BUY MULTIPLE GIFT CARDS IN ONE ORDER? OR PURCHASE A GIFT CARD WITH OTHER PRODUCTS?
No. When purchasing a gift card, customers will go directly to checkout after clicking Purchase. After your purchase you can then purchase another gift card separately.
CAN I DUPLICATE A GIFT CARD?
No. It isn't possible to duplicate a gift card.
CAN I RESTRICT GIFT CARDS TO CERTAIN ITEMS?
No. Gift cards can be used for any order of physical, digital, or service products. Gift cards can't be used for subscription products.
CAN I SET CUSTOM VALUES?
No, it is not possible to set a custom value.
CAN I EDIT THE GIFT CARD EMAIL?
No. The gift card email isn’t customisable at this time.
HOW DOES THE RECIPIENT CHECK THEIR BALANCE?
The recipient will receive an initial email with the gift card balance. After entering the gift card code at checkout, they'll see the remaining balance if there is any.
WHAT DO I DO IF A CUSTOMER LOSES THEIR GIFT CARD CODE?
Contact us and we can resend the gift email notification.
CAN CUSTOMERS ADD VALUE TO A GIFT CARD?
No, gift card balance cannot be topped up. However, you can purchase additional gift cards.
CAN CUSTOMERS SET A SPECIFIC TIME TO SEND THE EMAIL TO THE RECIPIENT?
No. Customers who want to send the email to the recipient at a later date should select the Email to You delivery option at checkout. They can then forward the email or .pdf at the desired time.
Use of the Climb Devon Logo and Name
The Climb Devon logo is pending trademark registration and is copyright protected automatically by UK legislation. Use of the Climb Devon logo and name without permission is prohibited. Jamie M. Langler t/a Climb Devon will defend the Climb Devon intellectual property (IP) and take action if someone is using it without permission (known as ‘infringement’).
We’ve spent a considerable amount of time developing the Climb Devon trademark and logo, and they are a part of the brand quality and consistency that our customers have come to know and trust. As important assets to our business, it’s vital that they’re used appropriately.
